Det. Harrison testified that there were three (3) hairs found.
One (1) was found and removed from a white plastic chair.
One (1) was found and removed from the right forearm of the victim.
One (1) was found and removed from the victims left butt cheek..

The coroner never testified about finding or removing any hairs from the victim.

During trial there was never any testimony or mention of a hair found in the pantyhose which was used as a
ligature.

Nor was there any testimony or mention of hairs found adhering to the terry cloth material (washcloth).

Rod Englert (state's blood spatter person) testified that he never examined any hairs taken from the scene or
decedents body.

Yet copies of Rod Englert's  Preliminary Report re: Ohio v. Hartmann, received under the Public Record Act, his
notes show;

  • "Item B1     Terry cloth material soaked with blood and numerous hairs adhering to same. (Analysis
    requested of hairs)". (page 6)
  • Item B15    Pair of torn pantyhose with bloodstains and knot near end of toe (long, dark hair removed from
    pantyhose for further analysis)". (page 5)
  • Item # B15 (from page 7 of handwritten notes regarding work done)
 "Pair of Panty Hose"
"1 Small Spot Of Blood Near End Of Toe"
" Long Dark Hair On Tape"
 "Placed The Hair In Envelope For Lab".

We question why the above information was not available at trial.
If it was tested, and it belonged to Brett,  Winda, or had been inconclusive, there would be no logical reason to
omit this evidence.

Non of the hairs in evidence were consistent with Brett's hair length or color.
Despite repeated requests by his appellate counsel, no DNA or any other tests have ever been performed on these
hairs.
