• A sponge mop was seized from the kitchen of Winda's apartment.

  • Det. Harrison testified he is the one who would attempt to lift any prints, if he could not, it would be
    sent to another lab.

  • The mop was presented in court with tape on the handle.

  • Det. Harrison testified "we had attempted to get, lift fingerprints off the handle of the mop".

  • He also testified "we didn't lift any prints off the mop, so, we left the tape there".

  • He further testified"we dusted it and did not lift any prints".

  • He explained, "it's taped because I didn't see any prints".

  • He admits, "this tape indicates that someone did try to lift a print", "and that print was unable to be
lifted, so the area is taped".

Det. Harrison clearly testified that no prints were ever lifted from the mop handle.

Yet when Brett's mother filed for and received copies of Brett's case, under the Public Record Act, the
following was found within those records.

  • A police report by CSI persons, including Det. Harrison, states, "mop handle was processed at the
station for fingerprints with several lifts being taken".

  • Another police report describing results of actions taken with items of evidence clearly states, "prints
    lifted from mop handle".

  • Pictures of print tape clearly shows prints were lifted from the mop handle.

Administrators note;
Obviously the print comparison must not have come back as belonging to Brett, Winda, or inconclusive.
Otherwise there would have been no logical reason for these reports and pictures to have been withheld
from Brett's trial counsel.
